AIGymLabs - Workouts — Terms of Service

These terms are an agreement between you and LaboGymIA inc., a company incorporated in Quebec, Canada ("we", "us"), covering your use of the AIGymLabs - Workouts mobile app, aigymlabs.com, and anything we provide with them.
AIGymLabs is the brand we trade under. LaboGymIA inc. is the legal entity you are contracting with.
The current version of these terms is always at https://legal.aigymlabs.com/terms/, and our Privacy Policy is at https://legal.aigymlabs.com/privacy/.
By creating an account or using AIGymLabs - Workouts, you accept these terms. If you do not accept them, do not use the app.
1. AIGymLabs - Workouts is not medical advice, and we are not clinicians
This is the most important section in this document.
We are not doctors, physiotherapists, athletic therapists, kinesiologists, or dietitians, and AIGymLabs - Workouts is not a medical device or a healthcare service. It is a training tool. It takes numbers you enter and applies published strength-training principles to produce a workout program.
Specifically:
- AIGymLabs - Workouts does not diagnose, treat, cure, prevent, or assess any injury, illness, or condition.
- Nothing in the app is a substitute for professional judgement about your body. An algorithm cannot see your knee.
- Consult a physician before starting any exercise program, and especially if you are pregnant, recovering from injury or surgery, managing a cardiovascular, metabolic, or musculoskeletal condition, taking medication that affects exercise capacity, or you are over 40 and have been inactive.
- Stop immediately if you experience chest pain, dizziness, faintness, numbness, or pain that is sharp rather than muscular, and seek medical attention.
Resistance training carries an inherent risk of injury. Loaded barbells, fatigue, and progressive overload are the mechanism by which the app works and also how people get hurt. By using AIGymLabs - Workouts you accept that risk voluntarily and take responsibility for your own decisions about what to lift, when to stop, and when to see someone qualified.
Where an exercise demonstration is shown, it depicts one performance of a movement for reference. It is not a certification that the movement is appropriate for you, and watching it is not coaching.
2. Your account
An account is required — your training history has to belong to someone, and that is the point of it.
Three ways to create one: with your Google account, with Apple sign-in, or with an email address and a password. They are equivalent; pick whichever you prefer. Whichever you pick, you are responsible for keeping it secure and for everything done through your account.
Practical things that follow from that choice:
- Use the same method each time. Signing in with Google and later with an email address that happens to match may produce a second, separate account with none of your history in it. If that happens, contact support and we will sort it out.
- If you revoke our access in your Google or Apple settings, or delete that account, you will not be able to sign in. Your data is not lost, but recovering access means contacting support and proving the account is yours.
- If you use Apple's "Hide My Email" and later turn the relay off, we can no longer reach you by email — including for anything we are required to tell you.
- Tell us promptly if you think someone else has access. Signing out on your devices invalidates the stored sign-in tokens.
- Do not share your account, and do not sign in on a device you do not control. A signed-in phone stays signed in for up to 90 days.
One person, one account. Do not create an account for anyone else, including a client, unless they are present and agreeing to these terms themselves.
You may delete your account at any time from inside the app. Deletion is permanent: your training history is removed and we cannot restore it. Deleting the app alone does not delete your account.
You must be at least 18 to use AIGymLabs - Workouts. Onboarding asks for your date of birth and will not let you continue if it puts you under 18.
3. What we grant you
A personal, limited, non-exclusive, non-transferable, revocable licence to install and use AIGymLabs - Workouts on devices you own, for your own training. That is all; we retain everything else.
4. What you may not do
- Use AIGymLabs - Workouts commercially — coaching clients from it, reselling programs it generates, or operating it as part of a paid service — without our written permission.
- Download, extract, copy, redistribute, or republish the exercise videos or images. This content is licensed to us, not owned by us, and the licence does not permit us to let you take the files. Streaming is what is licensed; extraction is not.
- Reverse-engineer, decompile, or attempt to derive our source code, except where law expressly permits it.
- Circumvent authentication, signed media links, rate limits, or any security measure; probe or load-test our infrastructure; or access another user's
data.
- Automate access — scraping, bots, or bulk requests — without permission.
- Upload anything unlawful, or use AIGymLabs - Workouts to harass anyone or break any law.
Breaking these is grounds for immediate termination.
5. Your content
Notes you write and data you log stay yours. You grant us only the licence necessary to store, process, and display that content back to you, and to generate your program from it — nothing more. We claim no right to publish your content, use it in marketing, sell it, or hold it after you delete your account. We do not use it to train machine-learning models.
Your training data is the only thing we collect besides what identifies your account. By logging workouts you are asking us to process that data — which we treat as sensitive health information — for the single purpose of building your program. The Privacy Policy sets out the legal basis, and you can withdraw it by deleting your account.
6. Premium subscriptions
What we offer
AIGymLabs - Workouts has a free tier and a Premium subscription, sold in two lengths:

The current price is shown in the app, in your local currency, before you confirm anything. Taxes are added by the store according to where you are.
Everything about money happens in the store
We do not process payments and we never see your card. All billing goes through the Apple App Store or Google Play, depending on where you got the app, and is also governed by that store's terms.
That means the store — not us — holds your payment method, charges you, sends your receipts, and manages your subscription. We are told one thing: whether your subscription is active.
Automatic renewal
Your subscription renews automatically. Unless you cancel, it continues period after period — monthly plans each month, yearly plans each year — and your payment method is charged at the then-current price each time.
The store charges you within 24 hours before the current period ends. This continues until you cancel; there is no fixed number of renewals and no end date.
Cancelling — you do it, in your store settings
You can cancel at any time, and you cancel yourself, in your Apple or Google account settings. We cannot cancel a subscription for you, and asking us, deleting the app, or deleting your AIGymLabs account will not stop the billing.
- iPhone / iPad: Settings → your name → Subscriptions
- Android: Google Play → your profile → Payments and subscriptions → Subscriptions
Cancel at least 24 hours before the current period ends, or that period's renewal may already have been charged. Cancelling is not a refund and is not immediate: you keep Premium until the end of the period you have paid for, and it simply does not renew after that.
Free trial — one per person
New users may be offered a free trial. If you take it:
- It converts automatically into the plan you chose — monthly or yearly — when the trial ends, and your payment method is charged at that point.
- To avoid being charged, cancel at least 24 hours before the trial ends, in your Apple or Google account settings, exactly as above.
- One trial per person. Trials are for new subscribers only. Eligibility is determined by the store against your Apple ID or Google account, so if you have used a trial before — including on another device with the same store account — you will be charged from the start rather than given a second one.
- If you cancel during the trial you keep Premium until the trial period ends, and are not charged.
- Trial length and availability are shown in the app before you start, and we may change or withdraw the offer for future users at any time. That never changes a trial already running.
Refunds are the store's decision, not ours
We do not issue refunds, because we never took the payment. All refunds are handled by Apple or Google under their own policies, and their decision is final.
- Apple: request a refund at reportaproblem.apple.com
- Google Play: request it through your Google Play order history
Partial periods are not refunded: cancelling mid-period does not produce a prorated refund from us. We will help you make a store request — tell support what happened and we will give you whatever information the store needs from us. Where a store grants a refund, Premium ends when the store reverses the purchase.
This paragraph does not remove any refund right you have under consumer law where you live; see the Quebec note below.
If payment fails
If a renewal payment does not go through, the store will normally retry for a while. If it ultimately fails, or you cancel:
- Premium features stop working at the end of the period you have paid for, or when the store ends the subscription.
- Your account and your training history stay exactly as they are. We do not delete your workouts, your program, or your history because you stopped paying. You keep the free tier, and everything you logged remains yours to read and export.
- Resubscribing restores Premium, with your history intact.
Price changes
If we change the price of a plan, existing subscribers are told in advance through the store and in the app, and you can cancel before the new price takes effect. Where the store requires your explicit consent to a price increase, your subscription will not renew at the higher price until you give it.
Consumer law
Quebec residents have rights under the Consumer Protection Act that these terms cannot reduce, including its rules on contracts of successive performance and on automatic renewal. Nothing in this section limits them, and where it conflicts with a right you have by law, the law wins.
7. Availability, and things breaking
We will try to keep AIGymLabs - Workouts working, but we do not promise uninterrupted or error-free service, and we may change or discontinue features. Where a change removes something you paid for, section 6 applies.
AIGymLabs - Workouts is designed to work offline for training, and your data lives on your device first. Signing in requires a network connection, and syncing requires one.
We may correct errors in content, pricing, or descriptions, including after they appear in the app.
8. Third-party stores and services
You get AIGymLabs - Workouts through the App Store or Google Play. Those companies are not parties to this agreement, have no obligation to support AIGymLabs - Workouts, and are not responsible for it. Where Apple's terms require it, Apple is a third-party beneficiary of these terms and may enforce them.
Sign-in through Google or Apple is subject to their terms and privacy policies as well as ours. Those companies decide whether your sign-in succeeds, and if one of them suspends or closes your account with them, we cannot sign you in with it — that is between you and them, though support can help you move to an email-and-password login instead.
9. Our intellectual property
AIGymLabs - Workouts, its name, design, code, and the programming logic behind it are ours or our licensors'. Nothing in these terms transfers any of it to you. The exercise demonstration content is licensed to us by its creator and remains theirs.
If you believe something in AIGymLabs - Workouts infringes your copyright, write to support@aigymlabs.com with enough detail to identify the work and your claim, and we will investigate and act where appropriate.
10. Warranties
AIGymLabs - Workouts is provided "as is" and "as available". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will make you stronger, that its recommendations suit your body, or that following them will avoid injury. Those outcomes depend on you, your recovery, your technique, and facts about you we cannot see.
Some jurisdictions, including Quebec, do not allow certain warranties to be excluded. Where that is so, this section applies only as far as the law permits, and your statutory rights stand.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost data, lost profit, or loss of use. Our total liability for any claim relating to AIGymLabs - Workouts is limited to the greater of the amount you paid us in the twelve months before the claim, or CAD $50.
Nothing in this section limits liability we cannot limit by law — including for gross or intentional fault, for bodily or moral injury caused by our fault under Quebec law, or for anything else non-excludable in your jurisdiction. If that makes this section unenforceable where you live, it does not apply to you.
12. Indemnity
You agree to indemnify us against claims arising from your breach of these terms, your misuse of AIGymLabs - Workouts, or your infringement of anyone's rights. We will tell you promptly of any such claim and let you participate in its defence.
13. Termination
You may stop using AIGymLabs - Workouts at any time and delete your account from the app.
We may suspend or terminate your account if you breach these terms, if we are legally required to, or if we discontinue the service. Where we discontinue the service, we will give reasonable notice and a means to export your data.
Deleting your account does not cancel your subscription — the store holds that, so cancel there first (section 6). Equally, cancelling a subscription does not delete your account: you drop to the free tier and keep your history.
If we terminate your account for breaching these terms, any paid period is not refunded by us; a refund request still goes to the store.
Your data rights on termination are in the Privacy Policy.
14. Governing law and disputes
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada, and disputes go to the courts of the judicial district of Montreal, Quebec.
There is no forced arbitration and no class-action waiver in these terms. Quebec's Consumer Protection Act would not enforce them against a consumer here, and pretending otherwise would be misleading. If you are a consumer outside Quebec, you keep whatever right to bring proceedings in your own jurisdiction your local law gives you.
Before filing anything, please write to us. Most problems are a misunderstanding, and we would rather fix it.
15. Changes to these terms
We may update these terms. For material changes we will notify you in the app before they take effect, and continuing to use AIGymLabs - Workouts after that constitutes acceptance. If you do not accept a change, stop using the app and delete your account.
16. Everything else
These terms, plus the Privacy Policy, are the whole agreement between us about AIGymLabs - Workouts. If a provision is unenforceable, the rest stands. Our not enforcing a provision is not a waiver of it. You may not assign this agreement; we may assign it in connection with a merger or sale of the business, on notice to you.
Language. The parties acknowledge that a French version of these Terms of Service was made available and accessible to them via their device settings or consent screen prior to acceptance, and that the parties have expressly requested that these Terms of Service and all related documents be drawn up exclusively in the English language.

Which version prevails. For users residing in Canada, the French version of these Terms of Service shall govern and prevail in the event of any conflict, discrepancy, or ambiguity between the French version and any translated version. For users residing outside of Canada, the English version of these Terms of Service shall govern and prevail. Any translations provided in other languages (including Spanish and Portuguese) are for courtesy and informational purposes only.
